Terms & Conditions

These Terms & Conditions were last updated on 15 June 2026.

1. Introduction

These Terms & Conditions apply to this website and to transactions relating to our products and services. You may also be bound by additional agreements relating to your relationship with us or to products or services you receive from us. If provisions of additional agreements conflict with provisions of these Terms, the provisions of those additional agreements take precedence.

2. Binding nature

By registering on, accessing, or otherwise using this website, you agree to the conditions set out below. Merely using this website implies knowledge and acceptance of these Terms & Conditions. In certain special cases, we may also ask for your express consent.

3. Electronic communication

By using this website or communicating with us electronically, you agree and acknowledge that we may communicate with you electronically on our website or by email, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement, including the requirement that such communications be in writing.

4. Intellectual property

We or our licensors own and control all copyright and other intellectual property rights on the website and the data, information, and other resources displayed on or accessible through the website.

4.1 All rights reserved

Unless otherwise stated, no licence or other right under copyright, trademark, patent, or other intellectual property rights is granted to you. This means you may not use, copy, reproduce, perform, display, distribute, embed in any electronic medium, alter, reverse engineer, decompile, transfer, download, transmit, monetise, sell, market, or commercialise resources from this website in any form without our prior written permission, unless mandatory statutory provisions (such as the right to quote) provide otherwise.

5. Third-party property

Our website may contain hyperlinks or other references to websites of other parties. We do not monitor or review the content of other parties' websites linked from this website. Products or services offered by other websites are subject to the terms and conditions of those third parties. Opinions or materials expressed on those websites are not necessarily shared or endorsed by us.

We are not responsible for the privacy practices or content of those websites. You bear all risks associated with using those websites and related third-party services. We accept no responsibility for any loss or damage of any kind arising from your disclosure of personal data to third parties.

6. Responsible use

By visiting our website, you agree to use it only for its intended purposes and within the scope of these terms, any additional agreements with us, and applicable laws, regulations, and generally accepted online practices and industry guidelines. You may not use our website or services to use, publish, or distribute material consisting of (or linked to) malicious computer software; you may not use data collected from our website for direct marketing activities or conduct systematic or automated data collection activities on or in relation to our website.

Participation in activities that cause or may cause damage to the website or impair its performance, availability, or accessibility is strictly prohibited.

7. Refund and return rights

7.1 Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period expires 14 days after the day of conclusion of the contract.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax, or email). Our contact details are set out below. You may use the attached model withdrawal form, but it is not obligatory.

If you use this option, we will promptly send you confirmation of receipt of such withdrawal on a durable medium (e.g. by email).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning exercise of the right of withdrawal before the withdrawal period has expired.

7.2 Effects of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (with the exception of supplementary costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within 14 days from the day on which we are informed of your decision to withdraw from this contract. We will use the same means of payment as you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees for such reimbursement.

If you requested that services begin during the withdrawal period, you shall pay us an amount proportionate to what has been provided until you communicated your withdrawal from this contract, in comparison with the full scope of the contract.

Please note that there are certain statutory exceptions to the right of withdrawal and therefore some items cannot be returned or exchanged. We will inform you if this applies in your particular case.

8. Idea submission

Do not submit ideas, inventions, works, or other information that may be regarded as your own intellectual property and that you wish to present to us unless we have previously signed an intellectual property agreement or confidentiality agreement. If you provide your content to us without such written consent, you grant us a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, store, adapt, publish, translate, and distribute your content in all existing or future media.

9. Termination of use

We may, at our sole discretion, temporarily or permanently modify or discontinue access to the website or any service on it. You agree that we shall not be liable to you or any third party for any such modification, suspension, or termination of your access to or use of the website or content you have shared on the website. You have no claim to compensation or other payment, even if certain features, settings, and/or content to which you contributed or on which you relied are permanently lost. You may not circumvent or attempt to circumvent any access restriction measures on our website.

10. Warranties and liability

Nothing in this section limits or excludes any implied warranty whose limitation or exclusion would be unlawful. This website and all website content are provided «as is» and «as available» and may contain inaccuracies or typographical errors. We expressly disclaim all express or implied warranties of any kind regarding the availability, accuracy, or completeness of content. We do not warrant that:

  • this website or our products or services will meet your requirements;
  • this website will be available uninterrupted, timely, secure, or error-free;
  • the quality of products or services you obtain through this website will meet your expectations.

Nothing on this website constitutes or is intended to constitute legal, financial, or medical advice of any kind. If you need advice, you should consult an appropriate professional.

The following provisions of this section apply to the maximum extent permitted by law and do not limit or exclude our liability in respect of matters where it would be unlawful for us to do so. In no event shall we be liable for direct or indirect damages (including damages due to loss of profit or revenue, loss or corruption of data, software, or databases, or loss or damage to property or data) arising from your access to or use of our website.

Unless expressly provided otherwise in an additional agreement, our maximum liability to you for all damages arising from or in connection with the website or products and services marketed or sold through the website, regardless of the legal theory imposing liability (whether in contract, equity, negligence, intentional conduct, tort, or otherwise), is limited to CHF 100. Such limitation applies to all your claims, actions, and causes of action of any kind and nature.

11. Privacy

To obtain access to our website and/or our services, you may be asked to provide certain personal details during the registration process. You agree that all information you provide will always be accurate, correct, and current.

We take your personal data seriously and are committed to protecting your privacy. We will not use your email address for unsolicited mail. All emails we send you relate exclusively to the provision of agreed products or services.

We have developed a policy to address privacy concerns. For more information, please see our Privacy Policy.

12. Export restrictions / compliance with laws

Access to the website from territories or countries where the content or purchase of products or services sold on the website is illegal is prohibited. You may not use this website in violation of Swiss export laws and regulations.

13. Assignment

You may not assign, transfer, or subcontract any of your rights and/or obligations under these Terms in whole or in part without our prior written consent. Any purported assignment in violation of this section is null and void.

14. Breach of these Terms & Conditions

Without prejudice to our other rights under these Terms & Conditions, in the event of a breach we may take such action as we deem appropriate, including temporarily or permanently blocking your access to the website, contacting your internet service provider to request that they block your access to the website, and/or initiating legal proceedings against you.

15. Force majeure

Except for payment obligations, a delay, failure, or omission by a party in performing or complying with any of its obligations under this agreement shall not constitute a breach of these Terms & Conditions if and for so long as such delay, failure, or omission arises from a cause beyond that party's reasonable control.

16. Indemnification

You agree to indemnify, defend, and hold us harmless from all claims, liabilities, damages, losses, and expenses arising from your breach of these terms and applicable laws, including intellectual property rights and data protection rights. You shall promptly indemnify us for our damages, losses, costs, and expenses arising from such claims.

17. Waiver

Failure to enforce any provision of these Terms & Conditions or any agreement, or failure to exercise a termination option, shall not constitute a waiver of those provisions and shall not affect the validity of these Terms & Conditions or any such agreement or any part thereof, or the right thereafter to enforce each individual provision.

18. Language

These Terms & Conditions are interpreted and construed exclusively in German. All notices and correspondence are drafted exclusively in that language.

19. Entire agreement

These Terms & Conditions, together with our Privacy Policy, constitute the entire agreement between you and Leading & Following regarding your use of this website.

20. Updating these Terms & Conditions

We may update these Terms & Conditions from time to time. It is your responsibility to review these Terms & Conditions regularly for changes or updates. The date stated at the beginning of these Terms & Conditions is the last revision date. Changes to these Terms & Conditions take effect once published on this website. Your continued use of this website after publication of changes or updates constitutes your agreement to comply with and be bound by these terms.

21. Governing law and jurisdiction

These Terms & Conditions are governed by the laws of Switzerland.

For all disputes arising in connection with these Terms & Conditions, the competent courts at the provider's registered office shall have jurisdiction, to the extent permitted by law.

If any provision of these Terms & Conditions is or becomes wholly or partly invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid provision that comes as close as possible to the economic and legal purpose of the original provision.
